1. Acceptance of Terms

Welcome to Scubair.org. By accessing our website, creating an account, paying a subscription, or logging a dive, you agree to be bound by these Terms and Conditions. If you do not agree, please surface immediately and do not use the site.


2. Eligibility and Certification

To use the advanced features of this site (like the Dive Planner or Citizen Science reporting), you must be:

  • At least 16 years old (or under the direct supervision of a parent/guardian).
  • A certified diver (or a student currently enrolled in a course with a recognized agency like BSAC, PADI, SSI, etc.).

Note: Using this site does not make you a diver. Only getting wet and trained by an instructor does that.


3. User Accounts & Security

You are responsible for keeping your password secure. We cannot be held liable if someone hacks your account because your password was "123456" or "scuba".

You agree to provide accurate information—especially regarding your emergency contacts and medical data. Providing false safety information puts you and your buddies at risk.


4. Payments, Subscriptions & Verification

Scubair operates on a paid membership model to ensure a verified, high-quality community.

  • Subscription Structure:
    • One-Month Access / Setup: A standalone charge (e.g., £5.00) covering account verification and 30 days of access.
    • Annual Subscription: A recurring yearly fee (e.g., £12.00) charged after the first month or paid upfront.
  • Automatic Renewal: To prevent service interruption, your Annual Subscription renews automatically unless cancelled.
  • Price Changes: We reserve the right to change our pricing. We will provide at least 30 days' notice via email before any price increase takes effect.

5. Cancellation & Refund Policy

We aim to be fair. Our refund policy ensures you only pay for the access you have used.

  • The "Setup & Access" Fee (£5.00): The initial £5.00 charge covers the cost of account verification, digital setup, and your first month of access. This fee is non-refundable, even if you cancel within the first 14 days, as the digital service is provided immediately upon sign-up.
  • Annual Subscription Refunds (£12.00):
    • Cancelling within Month 1: If you have paid the annual fee of £12.00 but cancel within the first 30 days, we will refund you £7.00. (This retains the £5.00 cost for the month of access you utilized).
    • Cancelling after Month 1: If you cancel after the first month has passed, no refunds will be issued for the remainder of the year. Your access will simply continue until your next renewal date.
  • How to Cancel: You may cancel your subscription at any time via your Account Dashboard or by contacting support.

6. User Content & Intellectual Property

A. Your Content

When you upload photos, logs, or comments, you retain ownership of them. However, you grant Scubair.org a license to display, store, and modify them (e.g., resizing a photo) for the purpose of running the site.

B. Community Guidelines & Prohibited Use

Don't be a "nark" (nitrogen narcosis induced trouble-maker). We strictly prohibit:

  • Dangerous advice that contradicts standard safe diving practices.
  • Abusive language, harassment, or hate speech.
  • Data Scraping: You may not use bots, spiders, scrapers, or other automated means to access or collect data from Scubair.org without our express written permission.
  • Spamming our forums or dive site comments.

We reserve the right to terminate the account of anyone violating these rules without refund.


7. The "No Liability" Clause

Please read this section carefully. It limits our liability.

Scubair.org is provided "as is." We are software developers and divers, but we are not your dive supervisor.

  • Software Errors: Software can have bugs. Tides change. Weather is unpredictable. We do not guarantee that the site will always be error-free or uninterrupted.
  • Assumption of Risk: You acknowledge that scuba diving involves inherent risks. You agree that your use of Scubair.org is entirely at your own risk.
  • Indemnity: You agree to indemnify and hold Scubair.org harmless from any claims arising out of your breach of these Terms or your violation of any law or the rights of a third party.

8. BSAC & Training Features

If you use our features to track BSAC training progress:

  • Digital vs. Physical: A "digital sign-off" on Scubair.org is a record-keeping tool. It does not replace the official certification card or Qualification Record Book (QRB) unless explicitly stated by BSAC HQ.
  • Instructor Authority: Only verified Instructors may sign off skills. Falsifying an instructor sign-off is grounds for an immediate ban (and is just generally bad karma).

9. Third-Party Links

Our site may contain links to other websites (like gear shops or weather stations). We are not responsible for their content or privacy practices. If you click a link and buy a leaky drysuit, that is between you and the shop.


10. Changes to Terms

We may update these terms occasionally. We will notify you of significant changes, but it is your responsibility to review them. Continued use of the site means you accept the changes.


11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
